These terms and conditions (“Terms”) govern your ability to redeem “Breeze Benefits” through your “M6toll account”. The “Breeze Benefits” are offered and provided by third party retail partners, brands or operators (each an “Operator”). References herein to “we” or “us” or “M6toll” are to Midland Expressway Ltd, headquarted at Operations Centre, Express Way, Weeford, Lichfield, Staffordshire WS14 0PQ.
ELIGIBILITY
To receive “Breeze Benefits” you must:
(a) be aged 17 years or over;
(b) have ownership of an ‘active’ ‘Personal’ M6toll account (with a positive credit balance, an active Vehicle Registration Number and up-to-date contact details).
(c) have the ability to receive electronic notifications from M6toll through the form of electronic communication we use from time to time (for example, an email address); and
(d) have the means to prove your M6toll account, e.g. an M6toll Account Statement.
Receiving Breeze Benefits promotional offers is free.
Breeze Benefits are for your personal use only and cannot be shared with any other person.
We reserve the right to refuse, merge or stop Breeze Benefits at any time.
TREATS and REWARDS
M6toll offers various benefits from time to time including, but not limited to, competitions, prize draws, passes and discount codes (“Treats and Rewards”).
Treats and Rewards may be redeemed in accordance with terms and conditions relevant to the specific promotion with the relevant participating Operator stated in the specific terms and conditions applicable to the promotion. We do not (other than as required by law):
(a) take any responsibility for any Treats and Rewards (including any damage, loss, liabilities or disappointment incurred or suffered by you or anybody else in connection with the Treat or Reward) provided by a participating Operator; and/or
(b) provide any warranties or representations, express or implied, regarding the goods or services (including without limitation the quality thereof) that you may obtain through the promotional offer from the relevant participating Operator.
Treats and Rewards are non-transferable (unless expressly mentioned in the particular offer) and cannot be bought, sold or in any way traded. There is no cash alternative.

(c) inform M6toll as soon as it is practicable if you become aware that someone has attempted to obtain Treats and Rewards using your personal details.
CHANGES TO THE TERMS
The Terms may be amended at any time by us and we will notify you of any changes by email before such changes come into effect.
We may at our discretion amend, decline to issue, withdraw or cancel Breeze Benefits or any particular Treats and/or Rewards at any time.
DATA PROTECTION
The M6toll Privacy Policy gives further information about how your personal data is collected and processed. The contract between us requires us to process your personal data in accordance with the Privacy Policy.
GOVERNING LAW
The Terms and any dispute or claim (including non-contractual disputes or claims) arising out of them, their subject matter or formation shall be governed by and construed in accordance with the law of England and Wales.
The courts of England and Wales will have non-exclusive jurisdiction to resolve any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with these Terms or their subject matter or formation.
